These terms govern the use of Simple Wave Search (https://simplewavesearch.com). Accessing the site and, in particular, creating an account imply full acceptance of these conditions, of the legal notice and of the privacy policy. Users who do not agree with them must refrain from using the service.

1. Safety warning. Please read carefully

Simple Wave Search provides forecasts and estimates for guidance only, produced automatically from third-party weather data and statistical models. The quality score expresses an estimate of how enjoyable surfing might be, not an assessment of how safe it is to enter the water.

Accordingly, the user acknowledges and accepts that:

  • The information on the site is not a maritime safety warning and does not replace the official warnings of the Spanish State Meteorological Agency, the Maritime Rescue service, Civil Protection, the port authorities or the lifeguard services of each beach.
  • Actual sea conditions may differ substantially from those forecast and may change within minutes. There are factors that are decisive for safety —rip currents, the state of the seabed, obstacles, crowding, water pollution or beach flags— which the site does not assess in any way.
  • Surfing is an activity that involves risks, including the risk of serious injury or death. The decision to enter the water is the user's alone, and must be taken according to their own experience, physical condition, direct observation of the conditions and the instructions of lifeguard staff.
  • The owners of the site accept no liability whatsoever for personal injury or material damage arising from decisions taken on the basis of the information published.

When in doubt, the judgement of the competent authorities and direct observation of the state of the sea must always prevail.

2. Description of the service

The site offers forecasts of sea conditions, an estimate of surf quality generated by machine learning models, informative guides to the beaches covered, a conversational assistant, a location map and, where applicable, access to third-party live cameras.

The quality estimates have been trained on ratings made by specific surfers and therefore reflect a subjective judgement that may not match each user's preferences, technical level or type of board.

3. User accounts

  • Registration requires a valid email address, a username and a password, and is permitted from the age of 14.
  • The user is responsible for keeping their password safe and for all activity carried out from their account. They must report to the owners any unauthorised use they become aware of.
  • Impersonating third parties is not allowed, nor is choosing offensive usernames or usernames that create confusion about who owns the site.
  • The user may delete their account at any time from the My account page, with the effects described in the privacy policy.
  • The owners may suspend or cancel accounts that breach these terms, that make abusive use of the service or that enter manifestly false data.

4. Content contributed by the user

The ratings and comments a user publishes are the raw material used to train and improve the prediction models. By submitting them, the user:

  • Declares that they reflect their real experience and that they do not include personal data of third parties or offensive, advertising or unlawful content.
  • Grants the owners a free, non-exclusive licence of indefinite duration to store them, process them in aggregated or dissociated form and use them to train the prediction models and produce statistics.

The owners may remove without prior notice any content that breaches the above.

5. Availability of the service

Access to Simple Wave Search is free for the user and the service is provided "as is". Uninterrupted availability, the absence of errors and the indefinite retention of information are not guaranteed. The owners may modify, suspend or discontinue the service, in whole or in part, at any time.

The service depends on external data sources —in particular Open-Meteo for weather and marine forecasting— whose outages or inaccuracies may affect the contents shown.

6. Advertising and sponsored content

The service is free for the user and may be financed through advertising and partnership agreements with third parties, such as surf schools or other bodies in the sector. Every commercial communication will be expressly identified as advertising or sponsored content, stating the advertiser where applicable.

Forecasts, quality scores and beach recommendations are generated using technical criteria and automated models, independently of those agreements.

Any service offered by third-party advertisers is contracted directly with them and governed by their own conditions; the owners of the site are not party to that relationship and are not responsible for its performance.

7. Third-party live cameras

The streams accessible from the site belong to their respective owners, are shown with the corresponding attribution and are only loaded when the user expressly requests it. The owners of the site do not control those streams and do not guarantee their availability or continuity, and may withdraw them at any time.

8. Limitation of liability

To the fullest extent permitted by applicable law, the owners shall not be liable for direct or indirect damages, loss of profit or loss of data arising from the use of, or the inability to use, the website or the information it contains. The foregoing is without prejudice to liability that cannot be excluded under the law, especially towards users acting as consumers.

9. Changes to the terms

The owners may modify these terms to adapt them to legal or service changes. The version in force will always be the one published on this page, stating the date it was updated. Continued use of the site after publication implies acceptance of the new version.

10. Applicable law

These terms are governed by Spanish law. For any dispute, the parties submit to the courts and tribunals with jurisdiction under the rules in force, without prejudice to the forum corresponding to the consumer user.
