1. Details of the owners

2. Purpose

Simple Wave Search is an informational website offering forecasts of sea conditions at certain beaches in Asturias, together with an estimate of surf quality produced by machine learning models, descriptive guides to each beach and a conversational assistant. Access to the site is free of charge, without prejudice to the cost of the user's internet connection.

This legal notice governs access to and use of the website. Browsing it confers the status of user and implies acceptance of the conditions set out here, of the terms of use and of the privacy policy.

3. Conditions of access and use

The user undertakes to make diligent use of the website and of the services accessible through it, in accordance with the law and this legal notice. In particular, the user undertakes to refrain from:

• Using the site for unlawful purposes or purposes harmful to the rights and interests of third parties.
• Carrying out actions that may damage, overload, disable or impair the website, its services or other users' equipment.
• Accessing or attempting to access restricted areas, other users' data or the owners' information systems without authorisation.
• Extracting the site's contents in an automated and massive manner without the owners' prior authorisation.

4. Intellectual and industrial property

The contents of the website —texts, beach guides, design, source code, prediction models, graphics and other elements— belong to Adrián Fernández Álvarez and Miguel de Orueta Rionda, or are used with the corresponding authorisation, and are protected by intellectual and industrial property law.

Their reproduction, distribution, public communication or transformation without the owners' express authorisation is prohibited, except for uses permitted by law. Partial quotation of content is allowed provided that the source is stated and a link to the website is included.

Weather and marine data come from Open-Meteo and are used in accordance with its terms of use. Mapping comes from OpenStreetMap and its contributors. Live camera images belong to their respective owners, who are identified next to each camera.

5. Exclusion of warranties and liability

The information published is for guidance only. The owners do not guarantee the accuracy, completeness or permanent updating of the contents, nor the uninterrupted availability of the website.

Forecasts and quality estimates do not constitute a maritime safety warning, nor do they replace the user's own judgement or the instructions of the competent authorities. The conditions applicable to this matter are set out in the terms of use.

6. Advertising and commercial partnerships

Access to the website is free for the user. Its upkeep may be financed through advertising and through partnership agreements with third parties, such as surf schools or other bodies in the sector.

In accordance with article 20 of the LSSI-CE, every commercial communication will be clearly identifiable as such, as will the person or entity on whose behalf it is made. Sponsored or paid content will be marked expressly and distinguished from editorial content.

Forecasts, quality scores and beach recommendations are produced using technical criteria and automated models, and are not influenced by commercial agreements.

7. Links to third-party sites

The website may contain links to third-party pages. The owners do not control those sites and are not responsible for their contents, privacy policies or practices.

8. Changes

The owners reserve the right to modify at any time the presentation, configuration and contents of the website, as well as this legal notice. Changes take effect from the moment they are published.

9. Applicable law and jurisdiction

These conditions are governed by Spanish law. For the resolution of any dispute arising from access to or use of the website, the parties submit to the courts and tribunals with jurisdiction under the applicable rules, without prejudice to the forum corresponding to the user when acting as a consumer.
